Data Controllers
Lincshomefinder is a partnership of City of Lincoln Council and North Kesteven District Council. The Partners are joint controllers of the personal data you provide.
What we use your personal data for
We are processing your personal data for the purposes of considering and administrating your application for housing.
Our lawful basis for processing your personal data
We must have a legal basis to process your personal data. Where we use personal data for the purposes of your application for housing the sections of the law that apply are:
UK GDPR Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the council.
For sensitive special category data (for example information about health conditions.
UK GDPR Article 9(2)(i) – processing is necessary for reasons of substantial public interest, on the basis of UK law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide suitable and specific measures to safeguard the fundamental rights and interests of the data subject.
Our statutory functions being set out in Part 6 & 7 of the Housing Act 1996, as amended by the Homeless Act 2012, Localism Act 2011 and the Homeless Reduction Act 2017.
Where any personal data requested, is not necessary for this purpose, you will be given an option to provide the information in your application and whether you choose to provide this or not will have no effect on your application..
Who might we share your personal data with?
These third parties may include, but are not limited to, where necessary passing your information and receiving information about you and your family with the agencies/services listed below:
- Other sections of either City of Lincoln Council or North Kesteven District Council and other Local Authorities
- Housing Associations/Providers where applicable for example L&H Homes, Platform, ONGO
- Landlords
- Support Agencies/Charities for example YMCA, Framework, We are with you
- Credit agencies
- General Practitioner’s (GPs)
- Department of work and pensions
- Police
- Health/Mental Health authorities
- Nominated third party – with your consent
This may include the sharing of your personal information which is sensitive for example regarding you or your family's health, although only where you have consented, or it is necessary to perform our statutory functions stated above. Where you provide information about your family
we assume you have done so with their consent.
We are also under a duty to protect the public funds we administer and we may use the information you have provided for the prevention and detection of fraud. How long we will retain your personal data for?
Data will be held for 6 years from the end of the tenancy agreement or any unsuccessful application.
What are my rights in relation to my personal data
You have the right to request access to your information, to request that it be rectified if incorrect, to object to or restrict its processing and to its erasure in certain circumstances.Your housing application is decided upon using a banding system.
